What is Remuneration?

 

Remuneration is a reward for the utilization of the Economic Rights of communication to the public of a Copyrights Works or Related Rights Product received by the creator or the owner of the Related Rights.

Who Are the Related Rights Holders Eligible To Receive Remuneration?

Based on Copyright Law Number 28 of 2014, phonogram producers and performers have the right to receive remuneration related to the use of sound recordings that contain the rights of phonogram producers as well as performers.

The collection of remuneration for these related rights includes the use of sound recordings by users in commercial venues.

Who Is Required to Pay Remuneration?

“Those who are required to pay remuneration are those who play and/or perform music/songs, in accordance with Government Regulation No. 56 of 2021 Article 3.”

1) Anyone can commercially use songs and/or music in the form of commercial public services by paying royalties to the creator, copyright owner and/or owner of related rights through LMKN.

2) The forms of commercial public performances referred to in paragraph (1) include :

  1. Commercial seminars and conferences.
  2. Restaurants, cafes, pubs, bars, bistros, nightclubs and discotheques.
  3. Musical concerts.
  4. Airplanes, buses, trains, and ships.
  5. Exhibitions and bazaars.
  6. Cinemas.
  7. Telephone music.
  8. Banks and offices.
  9. Retail stores.
  10. Recreation centers.
  11. Television broadcasting institutions.
  12. Radio broadcasting stations.
  13. Hotels, hotel rooms and hotel facilities.
  14. Karaoke business.

SELMI has been authorized by the LMKN to collect royalties/remunerations in accordance with the latest decree.
